ADULT & MINOR AMATEUR ATHLETIC WAIVER & RELEASE OF LIABILITY
ASSUMPTION OF RISK / WAIVER OF LIABILITY / INDEMNIFICATION AGREEMENT
In consideration of being permitted to participate in the Silverado Cup Karate Tournament (the “Event”), the undersigned acknowledges and agrees as follows:
1. Assumption of Risk
I understand that karate and martial arts competition involve inherent risks, including but not limited to serious bodily injury, permanent disability, paralysis, concussion, illness (including infectious diseases), and death. I knowingly and voluntarily assume all risks, both known and unknown, even if arising from the negligence of the Releasees (defined below), to the fullest extent permitted by law.
2. Statement of Health
I certify that I am physically fit, in good health, and able to participate safely. I agree to comply with all event rules and health guidelines. If I observe any unusual hazard, I will remove myself from participation and notify an official immediately.
3. Behavior and Conduct
Competitors must demonstrate good sportsmanship, discipline, and respect. Disruptive conduct, offensive language, illegal substances, alcohol possession, or unsafe behavior may result in immediate disqualification without refund.
4. Attendance Requirement
Competitors must report to their assigned ring when called. Failure to appear may result in disqualification according to tournament rules.
5. Release and Hold Harmless
I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, hereby release, indemnify, and hold harmless Silverado Cup, its directors, officers, staff, volunteers, referees, officials, sponsors, advertisers, venue owners, and affiliated organizations (collectively, the “Releasees”) from any and all claims, liabilities, damages, losses, or expenses arising out of or related to my participation in the Event, including travel to and from the Event, whether caused by negligence or otherwise, to the fullest extent permitted by Michigan law.
6. Medical Authorization
I authorize Event officials to obtain emergency medical treatment for me if necessary. I understand I am responsible for any medical expenses incurred.
7. Media Release
I grant Silverado Cup the unrestricted right to use photographs, video, or other recordings of me for promotional, educational, or commercial purposes without compensation.
8. Refund Policy
ALL REGISTRATION FEES ARE NON-REFUNDABLE, including but not limited to absence, scheduling conflicts, acts of nature, weather, or disqualification. Administrative and processing fees are non-refundable.
9. Governing Law & Severability
This agreement shall be governed by the laws of the State of Michigan. If any provision is held invalid, the remaining provisions shall remain in full force and effect.
FOR MINOR PARTICIPANTS (Under 18)
I certify that I am the parent or legal guardian of the minor participant. I consent to their participation and agree to all terms above on their behalf. I further agree to indemnify the Releasees from any claims brought by or on behalf of the minor.
I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
